phgems Terms & Conditions

1. Definitions

For the purposes of these Terms & Conditions, the following terms shall have the meanings ascribed to them below:

• "Platform" means the phgems website at phgems.cam and all associated gaming services, applications, and interfaces made available by phgems.
• "Account" means the registered user account created by you to access phgems services.
• "Real Money Gaming" means any game, bet, or wager placed using funds deposited to your phgems PHP wallet.
• "Bonus Funds" means any promotional credits, free spins, or matched deposit bonuses credited to your phgems account pursuant to an active promotion.
• "PAGCOR" means the Philippine Amusement and Gaming Corporation, the regulatory body overseeing gaming activities in the Philippines.
• "KYC" means the Know Your Customer identity verification process required by phgems prior to processing withdrawals and activating full account functionality.
• "PHP Wallet" means the Philippine Peso-denominated balance held within your phgems account.

2. Acceptance of Terms

2.1By accessing the phgems platform, registering an account, making a deposit, placing a wager, or claiming any promotional offer, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions in their entirety, together with our Privacy Policy and Responsible Gaming Policy, each of which is incorporated herein by reference.

2.2These Terms constitute the entire agreement between you and phgems regarding your use of the Platform and supersede all prior agreements, representations, or understandings whether oral or written.

2.3Your continued use of the phgems platform following any amendment to these Terms constitutes acceptance of the revised Terms. It is your responsibility to review these Terms periodically.

3. Eligibility & Age Verification

3.1Use of the phgems platform for real-money gaming is strictly restricted to individuals who meet all of the following eligibility criteria:

• You are at least 21 years of age, as required by PAGCOR for online gambling in the Philippines;
• You are a resident of the Philippines;
• You are legally permitted to engage in online gambling under the laws of your jurisdiction;
• You are acting on your own behalf and not as an agent, nominee, or representative of any third party;
• You are not a current employee, officer, director, or close relative of any employee of phgems or its affiliated entities.

3.2phgems reserves the right to request documentary proof of age and identity at any time. Failure to provide satisfactory KYC documentation within a reasonable period will result in suspension of real-money functionality and withholding of pending withdrawals until verification is complete.

4. Account Registration

4.1To access real-money gaming on phgems, you must register a personal account. During registration, you are required to provide accurate, current, and complete information including your legal name, date of birth, residential address, email address, and mobile number.

4.2Each individual may maintain only one (1) phgems account. The operation of multiple accounts — including accounts registered under different names, email addresses, mobile numbers, or payment methods — is strictly prohibited. phgems uses technical and analytical measures to identify duplicate accounts.

4.3You are solely responsible for maintaining the confidentiality of your phgems login credentials. You must not share your username, password, or any account access details with any third party. Any activity conducted through your account will be attributed to you.

4.4You must notify phgems immediately if you suspect unauthorised access to your account. phgems may provide a remote session-termination tool for this purpose, but cannot be held liable for losses incurred prior to notification.

4.5phgems reserves the right to decline any account registration application without providing reasons.

5. Deposits & Withdrawals

5.1All deposits to and withdrawals from your phgems PHP wallet are denominated in Philippine Peso. phgems accepts deposits via GCash, PayMaya, BPI, BDO, Metrobank, Visa, and Mastercard, subject to availability at the time of transaction.

5.2The minimum deposit amount is ₱100. Minimum and maximum withdrawal amounts are published on the Platform and may be amended from time to time.

5.3Withdrawals will be processed to the same payment method used for the most recent deposit unless you have received explicit written confirmation from phgems support authorising an alternative withdrawal channel.

5.4phgems will not process withdrawals until your KYC identity verification has been successfully completed. phgems reserves the right to request additional documentation — including source of funds documentation — prior to approving any withdrawal.

5.5Deposits sourced from funds belonging to third parties, or obtained through illegal means, will result in immediate account suspension and forfeiture of the relevant funds. phgems complies with Anti-Money Laundering (AML) obligations under Philippine law.

5.6phgems will not charge fees for standard GCash and PayMaya transactions. Third-party processing fees charged by banks or payment providers are outside phgems' control and are borne by the account holder.

6. Bonuses & Promotions

6.1phgems may offer promotional bonuses to new and existing members from time to time. All bonuses are subject to specific terms and wagering requirements stated at the time the promotion is offered. These specific bonus terms take precedence over general platform terms where they differ.

6.2Bonus funds credited to your phgems account may not be withdrawn until the applicable wagering requirement has been satisfied. Wagering requirements, eligible games, time limits, and maximum bet restrictions are displayed on each promotion's detail page.

6.3phgems reserves the right to amend, suspend, or withdraw any promotion at any time. Bonuses credited in error will be reclaimed regardless of whether related wagers have been settled.

6.4Claiming bonuses using duplicate accounts, using third-party funds, or engaging in low-risk "bonus abuse" betting patterns will result in forfeiture of the bonus and any winnings derived therefrom, and may result in permanent account closure.

7. Gameplay Rules & Fair Use

7.1Each game available on the phgems platform is governed by individual game rules, which are accessible within the game interface. Game rules are supplementary to these Terms.

7.2phgems uses certified Random Number Generator (RNG) systems for virtual games. Live casino games utilise physical dealing equipment in licensed studios. All game outcomes are the result of genuine randomness and are not manipulated.

7.3In the event of a disconnection during a live game session, phgems will apply the applicable game's disconnection policy. phgems shall not be liable for losses resulting from network failures, browser crashes, or connectivity issues on the user's end.

7.4Any malfunction in the gaming system that produces an irregular outcome voids all affected bets. phgems will apply reasonable measures to identify such malfunctions and notify affected users.

8. Prohibited Activities

8.1The following activities are strictly prohibited on the phgems platform and may result in immediate account suspension, forfeiture of funds, and referral to relevant authorities:

• Registering while under the age of 21 years;
• Operating more than one phgems account;
• Providing false or misleading information during registration or KYC;
• Using automated software, bots, scripts, or artificial intelligence tools to gain an unfair advantage;
• Engaging in collusion with other players in live or multiplayer game formats;
• Attempting to exploit software errors, system vulnerabilities, or glitches to accrue credits;
• Money laundering or using phgems to process funds derived from illegal activity;
• Accessing the platform via VPN, proxy, or other means to circumvent geographic restrictions;
• Harassing, threatening, or abusing phgems staff, dealers, or other players.

9. Responsible Gaming

9.1phgems is committed to promoting responsible gaming practices in line with PAGCOR's responsible gambling programme. The phgems platform provides the following tools, accessible within your account settings:

• Deposit limits — set daily, weekly, or monthly caps on how much you can add to your PHP wallet;
• Loss limits — cap the amount you can lose within a defined period;
• Session reminders — receive time-elapsed notifications during active sessions;
• Cooling-off period — temporarily suspend your account for a defined period;
• Self-exclusion — permanently or indefinitely close your account from real-money play.

9.2Self-exclusion requests submitted to phgems are permanent for the period specified and cannot be reversed during the exclusion window. phgems will not reactivate a self-excluded account upon request during the active exclusion period.

10. Intellectual Property

10.1All content on the phgems platform — including but not limited to the brand name, logo, website design, text, graphics, software, audio, and game interfaces — is the intellectual property of phgems or its licensors and is protected under applicable Philippine and international intellectual property laws.

10.2You are granted a limited, non-exclusive, non-transferable, revocable licence to access the Platform for personal recreational use only. This licence does not extend to copying, reproducing, distributing, publicly displaying, or creating derivative works from any phgems content.

11. Limitation of Liability

11.1To the fullest extent permitted by applicable Philippine law, phgems shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including but not limited to loss of profits, loss of data, or loss of goodwill.

11.2phgems' total aggregate liability to you for any cause of action arising from or related to these Terms or your use of the Platform shall not exceed the total amount deposited by you to your phgems account in the thirty (30) days preceding the event giving rise to the claim.

11.3phgems does not warrant that the Platform will be continuously available, error-free, or free of viruses or harmful components. Scheduled maintenance and unplanned downtime may occur.

12. Account Suspension & Termination

12.1phgems reserves the right to suspend or permanently close any account at any time, without prior notice, where phgems has reasonable grounds to believe that a user has breached these Terms, engaged in fraudulent conduct, or poses a risk to the integrity of the Platform.

12.2Upon termination, any real-money balance remaining in your PHP wallet (excluding uncleared bonus funds) will be returned to you via your registered withdrawal method, subject to completion of KYC verification and satisfaction of any outstanding wagering requirements.

12.3You may close your phgems account at any time by submitting a written request to phgems support. Account closure does not negate any outstanding obligations under these Terms.

13. Amendments to These Terms

13.1phgems reserves the right to amend these Terms & Conditions at any time. Amended Terms will be posted on this page with an updated effective date. Where the amendments are material, phgems will endeavour to provide reasonable prior notice via email or in-platform notification.

13.2Your continued use of the phgems platform following the posting of amended Terms constitutes your acceptance of the revised Terms. If you do not accept the revised Terms, you must discontinue use of the Platform and close your account.

14. Governing Law & Disputes

14.1These Terms & Conditions are governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to conflict of law principles.

14.2Any dispute, controversy, or claim arising out of or relating to these Terms or the use of the phgems platform shall first be referred to phgems' customer support team for resolution. If the dispute cannot be resolved informally within thirty (30) days, it shall be subject to the exclusive jurisdiction of the competent courts located in the Philippines.

14.3Nothing in these Terms limits your rights as a consumer under applicable Philippine consumer protection legislation.
